Terms & Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the Spark Legacy website, platform, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Who we are
Spark Legacy is a legal‑tech platform focused on helping individuals, families, and professionals organize information and workflows around wills, estate planning, and digital legacy. We are not a law firm and do not provide legal advice. Any legal questions about your situation should be directed to a qualified lawyer in your jurisdiction.
2. Eligibility & accounts
-
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.
-
You are responsible for maintaining the confidentiality of any login details and for all activities under your account.
-
You agree to provide accurate information and keep it up to date.
3. Nature of the service – no legal advice
-
The Services provide tools, workflows, and information to help you prepare for and organize estate‑planning tasks.
-
Information, templates, and guidance on the platform are for general information only and do not constitute legal, tax, financial, or investment advice.
-
Use of the Services does not create a solicitor‑client, attorney‑client, or other professional advisory relationship between you and Spark Legacy.
-
You are solely responsible for obtaining independent legal advice and ensuring that any documents or decisions are appropriate for your circumstances and compliant with applicable laws.
4. Acceptable use
You agree not to:
-
Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
-
Upload, share, or store content that is defamatory, discriminatory, offensive, or infringes on any third‑party rights.
-
Attempt to gain unauthorized access to the Services or to any other user’s account, data, or systems.
-
Reverse engineer, decompile, or otherwise attempt to extract the source code or underlying ideas of the Services.
-
Use automated tools (such as bots or scrapers) to access or copy the Services without our prior written consent.
We may suspend or terminate access to the Services if we reasonably believe these Terms have been breached.
5. Content you provide
-
You retain ownership of any information, documents, and materials you upload or create using the Services (“Your Content”).
-
You grant Spark Legacy a limited, non‑exclusive license to use, store, process, and back up Your Content solely for the purpose of operating and improving the Services.
-
You are responsible for ensuring that you have all necessary rights and permissions to upload and use Your Content on the platform.
6. Data, security, and third‑party services
-
We take reasonable technical and organizational measures to protect Your Content and personal data against unauthorized access, loss, or misuse.
-
We may use carefully selected third‑party service providers (for example, hosting, analytics, communication tools) to support the Services. Where we do so, we require those providers to handle data securely and in line with our Privacy Policy.
-
However, no system is completely secure, and we cannot guarantee absolute security.
(See our Privacy Policy for details on how we collect, use, and protect personal data.)
7. Intellectual property
-
The Services, including all software, text, graphics, logos, trade names, and other content created by or for Spark Legacy, are owned by Spark Legacy or our licensors and are protected by intellectual property laws.
-
You are granted a personal, limited, non‑exclusive, non‑transferable license to use the Services for your own internal, non‑commercial purposes, subject to these Terms.
-
You may not copy, modify, distribute, sell, or lease any part of the Services without our written consent.
8. Disclaimers
To the maximum extent permitted by law:
-
The Services are provided on an “as is” and “as available” basis.
-
We do not warrant that the Services will be uninterrupted, error‑free, or free from harmful components.
-
We do not warrant that any information or templates provided through the Services are complete, accurate, or suitable for your specific circumstances or jurisdiction.
-
You use the Services at your own risk and remain responsible for your own legal and financial decisions.
9. Limitation of liability
To the maximum extent permitted by law:
-
Spark Legacy and its founders, employees, advisors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the Services.
-
Our total aggregate liability for any claims arising out of or relating to the Services or these Terms will be limited to the amount you have paid (if any) for access to the Services in the twelve (12) months prior to the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
10. Changes to the Services and Terms
-
We may update or modify the Services from time to time.
-
We may also revise these Terms occasionally. When we do, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice.
-
Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
11. Termination
-
You may stop using the Services at any time.
-
We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms or if we discontinue the Services.
-
Sections intended to survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will continue to apply.
12. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them or the Services will be governed by and construed in accordance with the laws that apply in the primary jurisdiction where Spark Legacy is incorporated and operates (for example, Hong Kong law), without regard to conflict‑of‑law rules. Any disputes will be subject to the exclusive jurisdiction of the courts of that jurisdiction.
(You should have your lawyer insert the exact jurisdiction and dispute‑resolution mechanism.)
